A question many of you have asked about the trial is the possibility of the defense filling a motion to end it based on some of the absurdities of the Crown’s case and also what seems to be the Crown’s confusion about simple things like the rules of evidence. Kim Ayotte, who oversees city bylaw, paramedic and fire services and special events during last year’s demonstrations, was called as a witness to share his perspective on how the protest unfolded over the course of three weeks.
But delays in his testimony ultimately led one of the defence lawyers to put the court on notice that she will need to consider asking for the case to be dismissed if the trial continues to be plagued with delays.
The trial was supposed to last for sixteen days but it is growing and morphing with each delay and Justice Heather Perkins-McVey and her clerks are trying to sort out how they will solve calendar problems. Canadian Press gets props for honest reporting here and about the trial more broadly.
Barber’s lawyer Diane Magas says if the delays continue, she will need to consider making a Jordan application, which stipulates that any person charged with a crime has the right to be tried within a reasonable time frame.
“We have an obligation, if there’s going to be an issue, that we raise it at the earliest opportunity so that the Crown can respond appropriately,” Magas said outside of court.
The deadline for assessing whether a trial delay is reasonable is typically 18 months after the arrest, but in the case of Lich and Barber some of the delay is attributed to the defence.
That makes the deadline a “moving target” in this case, Magas said, since it’s still unclear when the trial will actually end.
Ayotte’s testimony was cut off again and again as he appeared unable to answer specific questions about his observations and actions during the convoy without referring to text and WhatsApp messages, emails and Teams chats with his staff.

I’m travelling back to Toronto in a few hours but will be thinking of all the protestors out and marching on behalf of removing trans ideology from our schools. Apparently teachers and their unions believe that if we oppose untested drugs and surgeries on kids we are hateful and far right. This is the desperate messaging of leftists who know they are losing the moral high ground. It is a page of the Trudeau’s playbook against the truckers and in my view, is fast losing steam. Stay cool-headed and remember you are dealing with cult-like and utterly dishonest zealots. Don’t engage and remain peaceful and full of love for your fellow protestors. They will name-call. They will play the totally bogus trans suicide card and try to link you to bad actors. Be cool. Know you are on the right side of history as are the two people in court today — a few blocks from the Parliament Hill demo. When in doubt ask what they would do. Love over fear is what truckers chanted. They sang O Canada.
Critical question of the day — teachers and their unions were also the ones whose selfishness and irrational fear of Covid-19 consigned children to isolation, depression and worse.
